Welcome to Lumora. These Terms of Service (“Terms”) govern your access to and use of our website (lumoracare.co.za, the “Site”), services, and merchandise (collectively, the “Services”). By using our Services, you agree to be bound by these Terms.

1. Who We Are

The Services are operated by Lumora (“Lumora,” “we,” “us,” “our”). “You” or “your” refers to the individual accessing or using the Services.

2. Acceptance of Terms

By accessing the Site or purchasing products, you agree to these Terms and to our Privacy Policy (incorporated by reference). If you do not agree, you may not use the Services. You must be of legal age in your jurisdiction (typically 18+) to access or use the Services or have parental/guardian permission.

3. Modifications

We may update these Terms at any time. The latest version will always be posted on the Site with an updated Effective Date. Continued use of the Services means you accept any revisions to the Site.

4. Intellectual Property

All content on the Site (designs, graphics, text, trademarks, logos, product images, compilations, etc.) is the property of Lumora or its licensors and is protected under copyright, trademark, and other intellectual property laws. No rights are granted to you except as expressly set forth here.

5. Limited License

You are granted a non-exclusive, revocable license to use the Site strictly for personal, non-commercial purposes. Any resale, distribution, or commercial use of products or Site content without prior written approval is prohibited.

6. Prohibited Conduct

You may not:

  • Resell products purchased from Lumora (except as authorized under specific reseller agreements).

  • Interfere with the operation of the Site or attempt unauthorized access.

  • Post, transmit or upload unlawful, defamatory, obscene, or infringing content.

  • Use the Site for illegal purposes or in violation of applicable law.

  • Employ automated tools (bots, crawlers, scrapers) without consent.

Violations may result in termination of access to the Site and legal action.

7. Accounts

Certain features on the Site may require you to create an account. You must provide accurate information and safeguard your login credentials. You are responsible for all activity under your account.

8. Product Availability & Descriptions

We aim to ensure the accuracy of product information but cannot guarantee availability, pricing accuracy, or error-free listings. Products may sell out quickly. Availability is not guaranteed until checkout is complete and payment is confirmed. We may discontinue or update products without notice.

9. Limited Edition Collections

From time to time, Lumora releases special limited edition product runs or seasonal collections (the “Collections”). These are subject to the following terms:

  • 9.1 Limited Quantities: Each Collection has a prescribed maximum number of units.

  • 9.2 Archival & Non-Repetition: Once a limited Collection sells out or its promotional period ends, it will not be restocked, reproduced or repeated.

  • 9.3 Order Placement: Orders are first-come, first-served. Checkout completion (payment + confirmation email) secures your order. Items in your cart are not reserved.

  • 9.4 Final Sale Policy: All special Collection products are final sale due to their limited nature. No returns or exchanges are permitted except for defective or incorrect items. Claims must be submitted within 7 days of delivery with order details and photos.

  • 9.5 Shipping Restrictions: Certain Collections may be region-specific. Orders placed outside permitted regions will be automatically cancelled and refunded.

  • 9.6 Resale & Authenticity: Collection products are intended for personal use only. Lumora does not guarantee authenticity or provide support for products purchased via third-party resellers.

10. Returns & Exchanges (Standard Merchandise)

For regular, non-collection merchandise:

  • Returns/exchanges are accepted within 10 days of delivery.

  • Hygiene Eligibility: Due to safety reasons, beauty and personal care products must be completely unopened, unused, with tags, and in their original packaging with protective seals intact to eligible for a return. Opened or sampled products cannot be returned.

  • Final sale items, gift cards and special Collection products are excluded.

  • Customers are responsible for return shipping unless the item arrived defective or damaged.

11. Shipping & Delivery

Standard shipping estimates are provided at checkout but are not guaranteed.  We are not liable for delays caused by carriers, customs, or force majeure events.

12. Disclaimer of Warranties

The Services and products are provided “as is” and “as available” without warranties of any kind, express or implied.

13. Limitation of Liability

To the maximum extent permitted by law, Lumora shall not be liable for indirect, incidental, or consequential damages. Total liability shall not exceed the greater of (i) R2000 or (ii) the total amount paid by you in the 12 months preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless Lumora and its affiliates, officers, employees, and agents from any claims, damages, or expenses arising from your use of the Services or breach of these Terms.

15. Dispute Resolution & Arbitration

Any disputes will first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be settled by binding arbitration under standard arbitration rules. You waive the right to a jury trial and class action participation.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of your primary business operating jurisdiction.
